- Analytics and reporting dashboards
Services are delivered through our platform, which is powered by GoHighLevel (GHL) infrastructure.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.
4. Acceptable Use
You agree not to use our services to:
- Violate any applicable law or regulation, including HIPAA, TCPA, or CAN-SPAM
- Send unsolicited communications to individuals who have not provided consent
- Transmit harmful, fraudulent, or misleading content
- Interfere with or disrupt the integrity of our platform
- Attempt to gain unauthorized access to any part of our systems
- Resell or sublicense our services without written permission
5. SMS and Communication Compliance
When using our SMS and communication features, you agree to comply with all applicable regulations including the Telephone Consumer Protection Act (TCPA) and A2P 10DLC requirements. You are responsible for obtaining proper consent from your patients and contacts before sending automated messages. You must honor all opt-out requests promptly.
6. HIPAA Compliance
Our platform is built on HIPAA-compliant infrastructure. We maintain a Business Associate Agreement (BAA) with GoHighLevel at the account level. As a covered entity or business associate, you are responsible for ensuring your use of our services complies with HIPAA requirements applicable to your practice. We do not independently store Protected Health Information (PHI) on our website.
7. Payment Terms
Fees for our services are agreed upon during the onboarding process. Unless otherwise specified:
- Subscription fees are billed monthly or annually in advance
- All fees are non-refundable except as required by law
- We reserve the right to modify pricing with 30 days' written notice
- Failure to pay may result in suspension or termination of services
8. Intellectual Property
All content, trademarks, logos, and intellectual property on our website and platform are owned by or licensed to MedGeniePro (a product of Shakan.AI LLC). You may not reproduce, distribute, or create derivative works without our express written permission.
You retain ownership of all data and content you provide to us. By using our services, you grant us a limited license to use your data solely to provide and improve our services.
9. Disclaimer of Warranties

We make no guarantees regarding specific results, including patient acquisition numbers or revenue outcomes.
10. Limitation of Liability
To the maximum extent permitted by law, MedGeniePro (a product of Shakan.AI LLC) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability to you for any claim shall not exceed the amount paid by you to us in the three months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless MedGeniePro (a product of Shakan.AI LLC), its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
12. Termination
Either party may terminate the service relationship with 30 days' written notice. We reserve the right to suspend or terminate your access immediately if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to our platform or other users.
